Terms of Service

1. Acceptance of Terms

By creating an account or using Kinligo ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. What Kinligo Is

Kinligo is a communication and care coordination platform that connects elderly residents, their families, and care facility staff. It allows families to stay informed about their loved ones and helps facilities communicate updates, photos, and notes.

3. Who Can Use Kinligo

You must be at least 18 years old to create an account.

There are three types of accounts:

  • Family Members — individuals with an authorized relationship to a resident
  • Residents — elderly individuals living in a participating care facility
  • Staff / Facility Administrators — employees of a registered care facility

You agree to provide accurate information when registering and to keep your account credentials private.

4. Authorized Use

You may only use Kinligo to:

  • Communicate with your care facility or family members about residents you are authorized to view
  • Access information about residents you have been granted permission to see
  • Submit payments for services you have enrolled in

You may not:

  • Access information about residents you are not authorized to view
  • Share your login credentials with others
  • Scrape, reverse engineer, or copy any part of the platform
  • Use the platform for any unlawful purpose
  • Impersonate another person or facility

5. Privacy and Sensitive Data

Kinligo stores and processes personal information, including names, contact details, photos, and notes entered by facility staff or family members. By using the Service, you acknowledge:

  • All resident data is visible only to authorized users
  • Family members may only access information about their own relative
  • Staff may only access residents within their assigned facility
  • We do not sell personal data to third parties
Important: Kinligo is not a HIPAA-compliant platform and should not be used to store or transmit protected health information (PHI) as defined under the Health Insurance Portability and Accountability Act. Do not enter clinical diagnoses, medical records, prescription details, or other regulated health information into Kinligo.

6. Payments

Certain features of Kinligo require payment. All billing is processed securely through Stripe. Kinligo never stores your credit card or payment details.

  • Subscriptions renew automatically unless cancelled before the renewal date
  • Refunds are handled on a case-by-case basis — contact hello@kinligo.com
  • Pricing may change with 30 days' written notice

7. Photos and Content You Upload

You may upload photos, documents, and notes through the Service. By doing so, you:

  • Confirm you have the right to share that content
  • Grant Kinligo a limited license to store and display it to authorized users
  • Agree not to upload anything illegal, harmful, or offensive

All files are stored in private, encrypted storage. They are never publicly accessible.

8. Facility Responsibilities

Care facilities using Kinligo agree to:

  • Only grant access to residents' families with proper consent
  • Keep resident information accurate and up to date
  • Designate an administrator responsible for managing staff access
  • Not enter protected health information (PHI) into the platform
  • Ensure their use of Kinligo complies with applicable local and national data protection laws

9. Account Termination

We may suspend or terminate your account if you:

  • Violate these Terms
  • Provide false information
  • Engage in behavior that harms other users or the platform

You may close your account at any time by contacting hello@kinligo.com. Upon closure, your data will be handled per our Privacy Policy.

10. Disclaimers

Kinligo is a communication tool, not a medical device or substitute for professional medical advice. Kinligo is not HIPAA compliant and is not intended for use as a medical records system or for storing regulated health information. We do not:

  • Provide medical diagnoses or treatment recommendations
  • Guarantee the accuracy of information entered by facility staff
  • Accept liability for decisions made based on information shared through the platform

The Service is provided "as is." We do our best to keep it available and secure, but we cannot guarantee uninterrupted access.

11. Limitation of Liability

To the fullest extent permitted by law, Kinligo's total liability for any claim arising from use of the Service is limited to the amount you paid us in the 3 months preceding the claim.

We are not liable for indirect, incidental, or consequential damages.

12. Governing Law

These Terms are governed by the laws of the State of California, USA. Disputes will be resolved in the courts of that jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you by email or in-app notice at least 14 days before changes take effect. Continued use after that date means you accept the new Terms.
